General terms
and conditions.
These terms define the framework applicable to orders, deliveries, returns and services offered by Swiss Race Customs.
1. Acceptance of the General Terms and Conditions
These General Terms and Conditions of Sale govern the contractual relationship between Swiss Race Customs, hereinafter referred to as “we” or “Swiss Race Customs”, operator of the website www.swissracecustoms.ch, and any natural or legal person making a purchase through our website, by email, by telephone or by any other means of communication, hereinafter referred to as the “customer”.
By confirming an order, the customer acknowledges having read these General Terms and Conditions and accepts them without reservation.
These Terms and Conditions apply to all products and services sold by Swiss Race Customs unless otherwise agreed in writing.
2. Orders and confirmations
Any order placed through our website constitutes a request to purchase the selected products.
The customer is responsible for checking the accuracy of the information provided, including contact details, delivery address, vehicle specifications and the references of the products ordered.
An electronic confirmation is sent once the order has been validated.
Swiss Race Customs reserves the right to refuse an order in the event of an obvious pricing error, product unavailability, payment issue or any other objectively justified reason.
In such a case, any amounts already received for products that are not supplied will be refunded.
Any person placing an order declares that they are at least 18 years old or have the authorisation of their legal representative.
3. Prices
Prices displayed on our website are stated in Swiss francs (CHF), including all applicable taxes.
Delivery charges are shown separately before final confirmation of the order.
Specific transport charges may apply to particularly large or heavy items. The final amount will be communicated to the customer for approval before any additional amount is invoiced.
Swiss Race Customs reserves the right to change its prices at any time. Orders already accepted are not affected by subsequent price changes unless otherwise agreed between the parties.
Any obvious display or pricing errors may be corrected before final acceptance of the order.
4. Payment methods
Swiss Race Customs offers several payment methods depending on the options available at checkout:
- Bank cards via WooCommerce
- Apple Pay
- TWINT
- Bank transfer or QR invoice
- Other payment solutions offered directly at checkout
Orders paid by bank transfer or QR invoice are processed after payment has effectively been received, unless otherwise agreed in writing.
Any transaction fees charged to the customer by a bank or financial institution remain the customer's responsibility.
If payment is rejected or fails, Swiss Race Customs is not required to place the corresponding order with its suppliers.
5. Product availability
Products offered by Swiss Race Customs may be available from our own stock, from our distributors or directly from manufacturers.
Availability information is provided on the basis of the information available to us.
A product displayed on our website may exceptionally become unavailable due to a stock shortage, production change or synchronisation error.
If an ordered product becomes unavailable, the customer will be informed and an alternative solution may be proposed.
If no solution is accepted by the customer, amounts paid for unavailable products will be refunded.
6. Delivery times
Products available in stock are generally dispatched within 24 to 72 business hours after payment has been received.
For products not available in stock, the standard delivery time is generally between 15 and 45 business days.
Certain items may require longer lead times, including:
- Custom-made coilovers and suspension systems
- Wheels manufactured to order
- Specific exhaust systems
- Bodywork and carbon components
- Products imported directly from manufacturers
- Equipment requiring specific manufacture or configuration
Delivery times provided are estimates based on information supplied by manufacturers, distributors and carriers.
Delays beyond our control may occur due to production, international transport, customs clearance or logistical difficulties.
In the event of a delay, Swiss Race Customs will inform the customer whenever reasonably possible and will take reasonable steps to obtain delivery as soon as possible.
Exceeding an estimated delivery time does not automatically entitle the customer to compensation. The customer's statutory rights in the event of delayed performance remain reserved.
7. Special orders and custom-made products
Certain items are ordered or manufactured specifically for the customer.
The following are considered special orders in particular:
- Coilovers with a customised configuration
- Custom-made suspension or suspension modified according to customer requirements
- Wheels manufactured to order
- Products with specific dimensions, finishes or characteristics
- Parts ordered exclusively for a particular vehicle or configuration
- Products expressly identified as special orders at the time of purchase
Once a special order has been accepted and forwarded to the supplier or manufacturer, it generally cannot be cancelled or modified without the written consent of Swiss Race Customs.
Products manufactured or ordered specifically for the customer are not eligible for return due to a change of mind or an incorrect choice by the customer.
The customer's rights in the event of defects, non-conformity or contractual non-performance remain reserved.
8. Delivery and transport
Goods are shipped primarily by Swiss Post or by partner carriers.
Shipping costs depend on the dimensions, weight, destination and nature of the items.
The customer is responsible for providing a complete and accurate delivery address.
Any additional costs caused by an incorrect or incomplete address provided by the customer may be charged to the customer.
Swiss Race Customs cannot guarantee a precise delivery date where delivery depends on an external carrier.
In the event of loss, theft or damage during transport, the customer is requested to contact Swiss Race Customs promptly so that an investigation can be opened with the carrier.
The allocation of risks and responsibilities is governed by the applicable contractual provisions and Swiss law.
9. Damage and delivery errors
The customer is requested to inspect the condition of the parcel and the items received upon delivery.
Any visible damage should, wherever possible, be reported immediately to both the carrier and Swiss Race Customs.
In the event of an incorrect delivery, incorrect product or damaged item, the customer must contact us as soon as the issue is discovered.
Photographs of the parcel, packaging and product may be requested in order to facilitate the handling of the case.
The product concerned should not be installed or modified before receiving our response.
The customer's statutory rights relating to defects and incorrect deliveries remain applicable.
10. Returns and voluntary return policy
For certain eligible products, Swiss Race Customs grants a return period of 10 days from receipt of the order.
Any return request must be submitted in writing within this period.
To be accepted under this voluntary return policy, the product must:
- Be new, unused and uninstalled
- Be returned in its original packaging
- Be complete with all accessories, hardware, instructions and packaging
- Show no signs of installation, use or damage
- Have received prior return authorisation
Any item that does not comply with these conditions may be refused.
The cost of returning products due to a change of mind is borne by the customer unless otherwise agreed.
No return may be shipped without prior authorisation.
This voluntary return policy does not limit the customer's statutory rights in the event of a defect or non-conformity.
11. Non-returnable products
For reasons relating to safety, conformity, homologation, importation or specific manufacture, the following categories are excluded from the voluntary return policy:
- Coilovers
- Shock absorbers and suspension kits
- Air suspension systems and related components
- Roll cages
- Strut braces and chassis reinforcement components
- Specific safety components
- Custom-made products
- Parts specially ordered for the customer
- Personalised items
- Installed, used or modified items
- Clearance items or items expressly identified as non-returnable before purchase
- Electronic items
The inability to return these items concerns voluntary returns due to a change of mind or an error by the customer.
Applicable statutory rights in the event of a manufacturing defect, incorrect delivery or non-conformity remain reserved.
12. Restocking fees
In certain exceptional circumstances, Swiss Race Customs may agree to accept the return of an item that would normally not be eligible for voluntary return.
Such acceptance remains at the discretion of Swiss Race Customs and requires prior written approval.
Where such an exceptional return is accepted, a restocking fee corresponding to 20% of the catalogue price of the item may be applied.
These fees cover, among other things, administrative, logistical, inspection and restocking operations.
The exact amount and refund terms will be communicated to the customer before acceptance.
These fees do not apply to returns resulting from a defect or an error attributable to Swiss Race Customs where the customer exercises statutory rights.
13. Warranties and defective products
Products sold by Swiss Race Customs benefit from the warranties provided by manufacturers as well as any applicable statutory or contractual rights.
The duration and terms of commercial warranties may vary depending on the brand and product category.
If a product is suspected of having a manufacturing defect, the customer must contact Swiss Race Customs and provide the information required to process the claim.
Depending on the applicable conditions, the product may be repaired, replaced or subject to another agreed or legally required solution.
The commercial warranty generally does not cover:
- Normal wear and tear
- Damage resulting from incorrect installation
- Unauthorised modifications
- Use that does not comply with the manufacturer's recommendations
- Damage caused by an accident
- Damage resulting from abusive or unsuitable use
- Damage resulting from insufficient maintenance
Warranty exclusions apply only to the extent permitted under Swiss law.
14. Wheels and tyres
The customer is responsible for checking that the selected dimensions and specifications are compatible with their vehicle.
This includes in particular:
- Wheel diameter and width
- Offset (ET)
- Bolt pattern and centre bore
- Brake caliper clearance
- Tyre dimensions
- Constraints related to suspension and bodywork components
Before fitting tyres, the customer or installer must verify that the wheels can be correctly fitted to the vehicle.
Tyre dimensions must likewise be checked before installation.
Products that have already been fitted or used are not accepted for return under our voluntary return policy.
Where specifications have been recommended or expressly confirmed by Swiss Race Customs, any potential liability remains determined according to the information exchanged and the applicable legal provisions.
15. Performance parts and installation
Swiss Race Customs specialises in the sale of automotive performance parts, including suspension systems, exhausts, braking systems, intake systems, wheels and equipment intended for road or track use.
Certain products require specific technical knowledge and should be installed by qualified professionals.
Swiss Race Customs cannot be held liable for damage caused exclusively by incorrect installation, improper use or modification performed by an independent third party.
Work carried out directly by Swiss Race Customs or under its responsibility remains subject to the applicable contractual and legal obligations.
The customer must comply with the manufacturer's instructions and the applicable safety requirements.
16. Swiss homologation
Certain products sold by Swiss Race Customs are supplied with Swiss homologation, a certificate of conformity or a specific technical document.
The availability and nature of these documents may vary depending on the vehicle, its configuration and the products selected.
Where homologation is expressly included in the sale, it forms part of the contractually agreed elements.
Documents may include:
- A Swiss homologation certificate
- A FAKT document
- A DTC report
- A certificate or technical documentation applicable to the vehicle concerned
The customer is responsible for providing the accurate information required to issue the documents, including the details shown on the vehicle registration document.
Additional administrative lead times may be required for the issue or procurement of homologation documents.
Swiss Race Customs cannot guarantee a precise issue date where a document depends on an external body or service provider.
The customer remains responsible for complying with the conditions and limitations contained in homologation documents, including permitted heights, dimensions, installation restrictions and technical requirements.
Final acceptance of the vehicle during a technical inspection depends on the vehicle's actual conformity and the competent authorities.
Swiss Race Customs does not guarantee that a vehicle will successfully pass inspection where it contains non-compliant modifications or elements unrelated to the products sold.
17. Track use
Certain products sold by Swiss Race Customs are intended exclusively for sporting, competition or track use.
Such products may not be approved for use on public roads.
The customer is responsible for checking the compliance of the parts with the legislation applicable in the country where the vehicle is registered and used.
The purchase of a product intended for sporting use does not constitute authorisation to use it on public roads.
To the extent permitted by law, Swiss Race Customs accepts no liability for illegal or non-compliant use of these products.
18. Order cancellation
Any cancellation request must be submitted to Swiss Race Customs in writing.
If an order has not yet been forwarded to the supplier or prepared for shipment, cancellation may be accepted.
For products already ordered from manufacturers, special orders or items already in production, cancellation may be refused where no statutory cancellation right applies.
An amicable solution may nevertheless be considered depending on the progress of the order and the supplier's conditions.
If cancellation is accepted, any applicable fees will be communicated to the customer before approval.
The customer's statutory rights in the event of non-performance or a contractually significant delay remain reserved.
19. Liability
Swiss Race Customs undertakes to process orders diligently and to provide the agreed products and services.
Swiss Race Customs cannot be held liable for damage resulting exclusively from:
- Incorrect installation by an independent third party
- Improper use of the product
- Unauthorised modifications
- Failure to follow the manufacturer's instructions
- Use contrary to applicable legislation
Swiss Race Customs' liability for indirect damage is excluded to the extent permitted by applicable law.
Nothing in these Terms and Conditions may exclude or limit liability where prohibited by law, in particular in cases of gross negligence or fraudulent intent.
20. Data protection
Swiss Race Customs processes its customers' personal data in accordance with applicable Swiss data protection legislation.
The information collected is used in particular for:
- Processing orders
- Invoicing
- Organising deliveries
- After-sales service
- Managing warranties and homologations
- Communications relating to purchases
Certain data may be transmitted to service providers necessary for the performance of the contract, including carriers, suppliers, payment providers or organisations responsible for homologation.
Swiss Race Customs does not sell its customers' personal data to third parties for advertising purposes.
Further details regarding data processing are set out in our Privacy Policy.
21. Intellectual property
All content on the website www.swissracecustoms.ch, including text, images, graphic elements, logos and original creations belonging to Swiss Race Customs, is protected by applicable intellectual property provisions.
Any unauthorised reproduction, distribution or use of such content is prohibited, subject to the rights of the respective rights holders.
22. Applicable law and disputes
These General Terms and Conditions are governed by Swiss law.
In the event of a dispute, the parties will endeavour to reach an amicable solution before initiating legal proceedings.
Subject to any mandatory places of jurisdiction provided by law, the competent courts are determined in accordance with applicable Swiss rules.
For any situation not expressly regulated by these Terms and Conditions, the relevant provisions of the Swiss Code of Obligations and other applicable legislation remain reserved.
23. Amendments to the General Terms and Conditions
Swiss Race Customs reserves the right to amend these General Terms and Conditions at any time.
Amendments take effect upon publication on the website for new orders.
Orders already concluded remain subject to the General Terms and Conditions applicable at the time they were accepted, unless otherwise agreed between the parties.
